Tours and Travel Terms and Conditions

These Terms and Conditions (“Terms”) govern the booking and use of travel and tour services provided by ExoticTravelNet.com (the “Company”). By booking a tour, purchasing a travel package, or using any services provided by the Company, you (the “Customer”) agree to these Terms.

1. Booking and Payment

  • Booking Process: To book a tour or travel package, customers must complete the online booking form or contact our customer service team. A valid credit card or other approved payment methods are required for booking.

  • Deposit and Full Payment: A non-refundable deposit may be required to secure a reservation. Full payment is due as specified in the booking confirmation. If the full payment is not made by the due date, the Company reserves the right to cancel the reservation and retain the deposit.

  • Pricing: All prices are listed in the currency specified on the website or invoice. Prices may vary based on availability, season, and other factors. Taxes, fees, and optional extras may be added to the total price.

  • Payment Methods: The Company accepts payments via credit cards, bank transfers, and other methods as stated on the website. The Customer is responsible for any additional fees related to payment methods, including exchange rate fees.

2. Tour and Travel Package Inclusions and Exclusions

  • Inclusions: The details of what is included in the price will be outlined in the tour description and booking confirmation. This may include transportation, accommodation, meals, and entry fees for included activities.

  • Exclusions: Any items or services not specifically mentioned as included are considered exclusions. Common exclusions may include personal expenses, tips, optional activities, travel insurance, and visas.

3. Cancellations and Modifications

  • Customer Cancellations: If a customer wishes to cancel a booking, the following cancellation policy applies:

    • More than 30 days before departure: Full refund minus the non-refundable deposit.
    • 15 to 30 days before departure: 50% refund minus the non-refundable deposit.
    • Less than 15 days before departure: No refund.
  • Company Cancellations: The Company reserves the right to cancel a tour or travel package for reasons such as insufficient bookings, force majeure, or operational issues. In such cases, the Customer will be offered a full refund or alternative arrangements.

  • Modifications: Any changes to an existing booking (e.g., dates, destinations) are subject to availability and may incur additional fees.

4. Travel Insurance

The Company recommends that Customers purchase travel insurance to cover trip cancellations, interruptions, medical emergencies, lost baggage, or other unforeseen circumstances. Travel insurance is not included in the tour price unless explicitly stated.

5. Responsibility of the Customer

  • Travel Documents: It is the Customer’s responsibility to ensure they have all necessary travel documents (e.g., passport, visas) for the tour. The Company is not liable for any costs or delays arising from failure to meet travel documentation requirements.

  • Health and Fitness: Customers must ensure they are in adequate health and physical condition to participate in the selected tour. Certain tours may require specific physical or medical abilities. Customers are responsible for informing the Company of any medical conditions that may affect their participation.

  • Behavior: The Customer agrees to behave in a manner that does not disrupt the enjoyment or safety of other participants. The Company reserves the right to remove any participant who behaves inappropriately, and no refunds will be given in such cases.

6. Tour Changes and Delays

The Company makes every effort to ensure that the itinerary runs as planned. However, due to unforeseen circumstances such as weather conditions, transportation delays, or other factors, it may be necessary to modify the itinerary. The Company will notify customers of any significant changes and may offer alternative arrangements or a partial refund if applicable.

7. Liability and Disclaimers

  • Liability: The Company acts as an agent for third-party service providers, including airlines, hotels, transport companies, and tour guides. The Company will not be liable for any personal injury, loss, damage, or delay caused by the actions or negligence of these third parties.

  • Force Majeure: The Company is not liable for failure to perform or delays caused by events beyond its control, including but not limited to natural disasters, strikes, civil unrest, or governmental actions.

  • Exclusion of Liability: Except as otherwise provided, the Company’s liability is limited to the total amount paid for the tour package. The Company will not be responsible for any consequential or incidental damages.

8. Force Majeure

The Company shall not be held liable for any failure or delay in the performance of its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, pandemics, wars, terrorism, strikes, or any other event of force majeure.

9. Travel Documents and Visas

  • Travel Documents: Customers are responsible for ensuring that they have valid passports, visas, and any other required documents for the destinations included in the tour. The Company is not responsible for any issues arising from the Customer’s failure to meet these requirements.

  • Visa Assistance: The Company may provide assistance with visa requirements, but it is ultimately the responsibility of the Customer to ensure they meet the visa criteria.

10. Privacy and Data Protection

The Company collects personal information from customers to process bookings and provide services. All personal information will be handled in accordance with the Company’s Privacy Policy, which can be found [here].

11. Disputes and Governing Law

  • Disputes: Any disputes arising out of or relating to these Terms shall be resolved through negotiation and mediation. If a resolution cannot be reached, the dispute will be handled in the courts of the jurisdiction where the Company operates.

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is registered, without regard to conflict of law principles.
